LUXE HOUSE MEDIA – MASTER TERMS & CONDITIONS

These Terms & Conditions (“Agreement”) apply to all services, products, and subscriptions provided by Luxe House Media (“LHM”), including but not limited to online course production, content creation, photography, website design, and hosting through Luxe House Courses (“Platform”).

By booking, paying, or maintaining an active subscription, the client (“Client”) agrees to the following:


1. Scope of Work

All deliverables, timelines, and project details are outlined in the corresponding proposal, quote, or invoice.

The listed deliverables are final. Any additional services, revisions, or requests outside the agreed scope require a separate agreement and additional payment.


2. Payments & Deposits

Full payment is required to secure your date.

A 50% deposit option may be offered at LHM’s discretion.

The remaining 50% is due on the shoot date before production begins.

(If applicable, otherwise 100% of the service fee is due upfront.)

All sales are final, non-refundable, and non-transferable.

Processing fees may apply for card transactions.

LHM reserves the right to withhold deliverables until payment is received in full.


3. Cancellations & Rescheduling

One courtesy reschedule is allowed if requested at least 7 days before the scheduled shoot.

Reschedules within 7 days are subject to a $250 fee.

Cancellations made with less than 7 days’ notice will result in forfeiture of any deposit.

No-shows or same-day cancellations are non-refundable.

LHM reserves the right to reschedule in the event of illness, emergencies, equipment failure, or force majeure events.


4. Project Timelines

Online Courses: Up to 7 weeks from the shoot date.

Luxe Content Day / Campaigns: Up to 10 business days from the shoot date.

Websites: Up to 4 weeks after all assets are received.

All other services: Standard delivery time is up to 10 business days, unless otherwise stated.

Timelines may vary depending on client responsiveness, project complexity, and revision requests.


5. Revisions & Editing

Each video or reel includes 1 revision for minor edits (timing, sound, color).

Additional revisions are billed at $100 per video per round.

Major changes, reshoots, or creative direction changes after filming require a new booking.


6. Client Responsibilities

The Client must:

Arrive prepared, on time, and ready to begin.

Provide access to the shoot location and all required assets.

Maintain a safe, professional environment during production.

Delays or unpreparedness may reduce shooting time without affecting the agreed price.


7. Rights & Usage

LHM retains ownership of all raw content, footage, and working files.

Edited content is licensed to the Client for personal or business use only.

Raw files are not released unless otherwise agreed in writing.

LHM may use completed work for portfolio and marketing purposes unless the Client opts out in writing before production.


8. Safety & Conduct

LHM may pause or stop production if unsafe or unprofessional conditions arise.

Such interruptions do not entitle the Client to any refund or reshoot.


9. Subscriptions & Hosting (Luxe House Courses)

These terms apply to Clients hosting their online courses with Luxe House Courses, a division of Luxe House Media.

Service Overview

Luxe House Courses provides secure hosting and maintenance for online courses built and produced by LHM.

Hosting ensures the Client’s course remains live, functional, and accessible to enrolled students while LHM manages backend operations, payment processing, and technical support.

Hosting Fees & Billing

Standard Hosting Fee: $100/month

Payment Processing Fee: 5% per transaction

Hosting fees are billed automatically each month unless canceled.

All payments are non-refundable and non-transferable.

Hosting begins once the course is published and remains active until the subscription is canceled or payment fails.

LHM reserves the right to pause or remove hosting for non-payment or failed billing attempts.

Cancellation

Clients may cancel hosting anytime by ending their subscription.

Upon cancellation:

The hosted course will be deactivated.

Student access will be removed.

LHM can provide downloadable final edited course files once all payments are cleared.

No refunds or credits will be issued for unused portions of the billing cycle.

Ownership & Access

The Luxe House Courses platform and backend systems remain the exclusive property of LHM.

Clients retain ownership of all course videos and materials created for their course.

Hosting fees grant a non-exclusive, revocable license to use the platform while the subscription is active.

If hosting is canceled or expires, all content and student data may be securely deleted after 30 days.

Included Services

Hosting includes:

Course hosting and uptime maintenance

Student access management

Payment and checkout support

Minor system updates and monitoring

Hosting does not include:

Course rebuilds or redesigns

New content uploads or editing

Marketing or automation setup

Custom integrations

Additional work requires a separate agreement and fee.

Liability & Service Interruptions

LHM makes reasonable efforts to maintain uptime and security but is not liable for interruptions caused by third-party providers, payment gateways, or internet outages.

Total liability shall not exceed the total hosting fees paid.

Non-Refundable Terms

All hosting and processing fees are final.

Failure to maintain active payments results in course deactivation and removal after 30 days.


10. Confidentiality

Both parties agree to maintain confidentiality of any proprietary or sensitive information shared during the project.


11. Indemnification

The Client agrees to indemnify and hold harmless LHM, its owner, and contractors from any claims, damages, or losses arising from misuse of deliverables or breach of this Agreement.


12. Limitation of Liability

LHM’s total liability shall not exceed the amount paid for the specific service.

LHM is not liable for indirect, consequential, or incidental damages, including lost profits or delays.


13. Force Majeure

Neither party shall be liable for delays or non-performance due to causes beyond reasonable control, including natural disasters, illness, or government restrictions.


14. Governing Law

This Agreement is governed by and interpreted under the laws of the State of Florida, without regard to conflict of law principles.
